By accessing or using Xora, you agree to be bound by these terms. Please read them carefully before using the platform.
1. Eligibility
To use Xora, you must be at least 18 years old and legally able to enter into binding agreements in your jurisdiction. By creating an account, you represent that you meet these requirements and that any information you provide is accurate and complete.
Xora services may not be available in all jurisdictions. It is your responsibility to ensure that your use of the platform complies with applicable local laws and regulations.
2. Your Account
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access.
We reserve the right to suspend or terminate accounts that violate these terms, engage in suspicious activity, or pose a risk to the platform or other users.
3. XRP Deposits and Yields
Xora allows you to deposit XRP and earn yield on your holdings. By depositing XRP into Xora, you acknowledge and agree to the following:
- Yield rates (APY) are estimates, not guarantees. Rates may fluctuate based on market conditions, protocol performance, and platform adjustments.
- Advertised APY figures represent current target rates and are subject to change at any time without prior notice.
- XORA token rewards are distributed as a separate component of your total yield and may be subject to their own terms and conditions.
- Your deposited XRP is held in custodial wallets managed by Xora. While we implement robust security measures, deposits are not insured by the FDIC, SIPC, or any government agency.
Risk disclosure: Cryptocurrency is inherently volatile and carries significant risk. The value of XRP and XORA tokens can decrease substantially. You could lose some or all of your deposited assets. Only deposit what you can afford to lose.
4. Withdrawals
You may request withdrawal of your XRP at any time, subject to the following:
- Withdrawals are processed to the XRP Ledger address you specify. You are solely responsible for providing a correct destination address.
- Processing times may vary. While we aim to process withdrawals promptly, delays may occur due to network congestion, security reviews, or technical issues.
- Xora reserves the right to impose withdrawal limits or holds for security and compliance purposes.
- Transactions sent to incorrect addresses cannot be reversed or recovered.
5. Xora Card
The Xora Card is an upcoming feature that will enable you to spend your XRP balance at merchants worldwide. When launched, the Xora Card will be subject to additional terms and conditions, including those of our card-issuing partners.
Features, availability, and specifics of the Xora Card described on the platform are forward-looking and may change before or after launch.
6. Prohibited Activities
You agree not to use Xora for any of the following:
- Money laundering, terrorist financing, or any form of illicit financial activity
- Circumventing sanctions, export controls, or trade restrictions
- Fraudulent transactions or misrepresentation of identity
- Attempting to exploit, hack, or disrupt the platform or its infrastructure
- Using automated bots, scrapers, or similar tools without authorization
- Creating multiple accounts to abuse promotions, yields, or referral programs
- Any activity that violates applicable laws or regulations
7. Disclaimers
Xora is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee uninterrupted access, error-free operation, or that the platform will meet your specific requirements.
Nothing on the Xora platform constitutes financial, investment, legal, or tax advice. You are solely responsible for evaluating the risks and merits of using the platform and managing your digital assets.
Xora is not a bank. We do not hold a banking license and are not regulated as a banking institution. References to "neobank" describe the nature of the platform's services, not its regulatory status.
8. Limitation of Liability
To the maximum extent permitted by law, Xora and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to:
- Loss of funds due to market volatility, smart contract failures, or blockchain network issues
- Unauthorized access to your account resulting from your failure to secure credentials
- Errors in yield calculations or delayed distributions
- Service interruptions, downtime, or data loss
- Actions taken by third-party service providers (Clerk, Plaid, Dwolla, XRPL validators)
Our total aggregate liability for any claim arising from or related to these terms shall not exceed the amount of fees you have paid to Xora in the twelve months preceding the claim.
9. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of Xora shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
10. Changes to These Terms
We reserve the right to modify these terms at any time. Material changes will be communicated through the platform or via email. Your continued use of Xora after changes are posted constitutes acceptance of the updated terms.
